RE:
Request that the Board waive the two (2) $2,000.00 campaign finance late fees ($4,000.00 total) assessed against W. Thomas Barrett, III, a successful candidate for District Attorney, 38th Judicial District Court in the November 3, 2020 election, whose 2022 and 2023 Supplemental campaign finance disclosure reports were filed 663 and 304 days late, respectively.
Facts:
W. Thomas Barrett, III requests a waiver and states the following: On 11/12/2024, W. Thomas Barrett received two FTF notices via email. Initially, the notices were mailed to his previous address, so he never received them. He states that his reports will be filed immediately, and they will show that there was no activity in 2022 or 2023 except for monthly service fees. The ending balance as of 12/31/2021 was $1,542.57, which is also the date of his last report. Mr. Barrett left the account open because he loaned the campaign $22,385.69 and thought he might raise money to pay himself back, but that did not happen. He did not file on time because he misunderstood the rules. Mr. Barrett would like to apologize for the oversight and request a waiver of the assessed late fee.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.
LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.
Recommendations:
With respect to SUPP2022, reduce to $1,200 based on Rule 1205C; decline to waive.

With respect to SUPP2023, reduce to $600 based on Rule 1205C; decline to waive.
