Untimely request that the Board waive the $800.00 campaign finance late fee assessed against Mark E. Milligan, an unsuccessful candidate for East Baton Rouge Sheriff in the October 12, 2019 election, whose 2023 Supplemental campaign finance disclosure report was filed 8 days late.
Facts:
Mark E. Milligan is submitting a waiver and states the following: He called the BOE on 2/23/24 and was informed that filing notices would no longer be sent via mail and would be delivered electronically. He would have gladly adhered to the change in delivery method. However, he is confused about why there weren't any notifications referencing the change, and still, some notices were delivered via mail. While reviewing his email, he located the letter indicating that he needed to file the report, confirming what was said during the phone call. He filed that same day and demonstrated that he had not raised enough money to offset the deficit. Mr. Milligan believes this mishap could have been avoided had he been notified of the change. He would like to request a late fee waiver and make an appearance.


Waiver request was received on November 21, 2024. Mr. Milligan states he initially sent the letter on June 28, 2024 (which would have been timely) via US mail, but he believes it was not delivered.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

Recommendations:
Consider untimely request; decline to waive.
