RE:
Request that the Board waive the $1,000.00 campaign finance late fee assessed against Erin Riecke Rowan, an unsuccessful candidate for Council Member, District 2, St. Tammany Parish in the October 14, 2023 election, whose 2023 Supplemental campaign finance disclosure report was filed 258 days late.
Facts:
Erin Riecke Rowan is submitting a waiver and states the following: She completed the required training but was unaware that a report needed to be filed for outstanding loans of personal funds extended to her campaign. She was informed of the delinquency on 10/30/2024 via phone and immediately completed the report on that date. Ms. Rowan believed the zero balance on her previously filed disclosure report was sufficient to fulfill her campaign disclosure obligations and would like to apologize for the misunderstanding. The campaign post office box and email accounts have been closed to ensure no further expenses that need to be reported. Therefore, she had not received any prior notices. This was Ms. Rowan's first campaign, and she has been diligent in rectifying the late filing.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.


Recommendations:
Reduce to $400 based on Rule 1205C; decline to waive.
