Correspondence from the Louisiana Manufacturers Political Action Committee ("LAMP") requesting that the Board waive the statutory provisions of La. R.S. 18:1511.2 regarding contribution limits of big PACs as implemented by Act 664 of the 2024 Legislative Session.
Facts:
The Louisiana Manufacturers Political Action Committee ("LAMP") is affiliated with the Louisiana Chemical Association.
LAMP was classified as a Big PAC from 2003 to 2020. It was classified as a regular PAC for 2021 and 2022 (based on the contribution amounts in the prior calendar year). Then was classified as a Big PAC again in 2023 and 2024.

LAMP has filed a 2025 Statement of Organization. It is currently classified as a regular PAC. This results in LAMP being subject to the following contribution limits:


$12,000 - Major Office Candidates

$6,000 - District Office Candidates

$2,000 - Any Other Office Candidates.


However, if LAMP were classified as a Big PAC, those contribution limits would double:

$24,000 - Major Office Candidates

$12,000 - District Office Candidates

$4,000 - Any Other Office Candidates


Law:
La. R.S. 18:1505.2(H)(2)(a):

Notwithstanding the provisions of Paragraph (1) of this Subsection, the following contribution limits are established for contributions by political committees supporting or opposing a candidate for the following offices:

(i) Major office - twelve thousand dollars.
(ii) District office - six thousand dollars.
(iii) Other office - two thousand dollars.
(b)(i) Notwithstanding the provisions of Paragraph (1) of this Subsection and Subparagraph (a) of this Paragraph, the following campaign contribution limits are established for contributions by political committees supporting or opposing a candidate for the following offices, the membership of which political committee exceeds two hundred fifty members as of the December thirty-first of the preceding calendar year, and additionally, provided that at least two hundred fifty of the members have each contributed at least one hundred dollars to the political committee during the preceding one-year period:
(aa) Major office - twenty-four thousand dollars.
(bb) District office - twelve thousand dollars.
(cc) Other office - four thousand dollars.
La. R.S. 42:1134 provides that the Board of Ethics may adopt, amend, repeal, and enforce rules and regulations in the manner provided in the Administrative Procedure Act to carry out the provisions and purpose of this Chapter and any other law within its jurisdiction.

La. R.S. 49:964(A)(1) (Administrative Procedure Act): An interested person may petition an agency requesting the adoption, amendment, or repeal of a rule ... Within ninety days after submission of a petition, the agency shall either deny the petition in writing, stating reasons for the denial, or shall initiate rulemaking proceedings in accordance with [the Administrative Procedure Act].

La. R.S. 49:961(A)(1): An agency shall give notice of its intention to adopt, amend, or repeal any rule and a copy of the proposed rules at least ninety days prior to taking an action on the rule.

...

(3) The notice shall be published at least once in the Louisiana Register and shall be submitted with a full text of the proposed rule to the Louisiana Register at least one hundred days prior to the date the agency will take action on the rule.


Recommendations:
Deny the request for rule-making.
