RE:
Request that the Board waive reconsider the decision to decline to waive the $1,000.00 campaign finance late fee assessed against, Patricia "Patty" McCarty, a successful candidate for Member of Parish Council, District 5, Plaquemines Parish in the November 8, 2022, whose 2023 Supplemental campaign finance disclosure report was file 280 days late.
Facts:
Original request from Patricia "Patty" McCarty stated the following: She has $1,100 in her campaign account, which was deposited before her election and taking office on 1/1/2023. After receiving the FTF notice, it was brought to her attention that she needed to file a supplemental report annually, even though there was no activity throughout the year. Ms. McCarty plans to enlist an accountant familiar with CF reports and would like to ask that her fine be reduced or suspended.

Reconsideration request provides no new information except that the report has now been filed.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.


Recommendations:
Reduce to $400 based on Rule 1205C; decline to waive.
