Advisory Opinion request as to whether the post-employment restrictions in the Code of Governmental Ethics ("Code") prohibits the Operations Manager of Mosquito Control with the Calcasieu Parish Police Jury, following retirement, from working with a private company which previously was a vendor of the Calcasieu Parish Police Jury. |

Ronald Scott Harrington (Mr. Harrington) is currently employed as the Operations Manager with the Mosquito Control Department of the Calcasieu Parish Police Jury. He reports to the Director of Mosquito Control, Nathan Areno. He supervises other staff in his area of operations. His job duties and responsibilities include but are not limited to, assisting the Director in developing, implementing, and evaluating programs within Mosquito Control; assisting the Director with the preparation of the budget; reviewing performance data to monitor and measure productivity, goal progress, and activity levels; and, overseeing initiatives within Mosquito Control to enhance and improve service delivery.
Mr. Harrington stated that he will be retiring soon. He would like to accept employment in a sales position with a private company, Azelis AE&S. He would serve as an outside sales representative for all of Louisiana and Mississippi. During his tenure with Mosquito Control, Mr. Harrington purchased chemicals and equipment from Azelis AE&S. He asks whether the company will be allowed to continue business with Calceasieu Parish if he has no dealing with procurement, bidding, etc. on transactions between the parish and the company.

La. R.S. 42:1121B. No former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following the termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
