Waiver request submitted by David A. Johnson, Rapides Parish Police Juror / District H / Rapides Parish, regarding a $2500 late fee assessed for filing his 2023 Tier 2 annual pfd 76 days late.
Facts:
Since David A. Johnson left office in January 2024, he overlooked that he needed to complete his PFD by 5/15/2024. He received the FTF notice a week after his mother-in-law was laid to rest and he and his wife became full-time caregivers of his 83-year-old father-in-law. It is still difficult. They filed an extension for their 2023 income taxes, and they weren't completed at that time. His accountant said that she would tell the BOE representatives about the extension and they would file a delinquent report. Mr. Johnson had no idea that it had not been taken care of until he received the LFO and will not be able to contact his accountant until she is back in the office on 10/7/2024.The report has since been completed. Due to the reasons mentioned, Mr. Johnson would like to request a waiver of the $2,500 late fee.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all but $1250 based on future compliance with the Code of Ethics. The $1250 is payable within 20 days and if payment is not received within 20 days, the full amount of the late fee becomes due and owing.
