Waiver request submitted by Henry A. Schumacher, former member of the Tangipahoa / St. Helena Soil & Water Conservation District, regarding a $1500 late fee assessed for filing his 2022 Tier 2.1 annual pfd 196 days late.
Facts:
Patrick G. Klein is submitting a waiver on behalf of Henry A. Schumacher. Mr. Schumacher began serving on the Tangipahoa St. Helena Soil & Water Conservation District Board in 2005, took a break in 2014, and returned in 2019. In December 2021, he had a farming accident that caused a brain bleed, which led to dementia. His wife, Karen Schumacher, cared for him around the clock while also caring for her mother, who also had dementia. Mrs. Shumacher was diagnosed with breast cancer in 2022, and her mother passed away shortly after. Mrs. Schumacher received the FTF notice but did not respond because she did not understand the seriousness of the request. When she received the LFO, she contacted the SWCD Board and was told that a BOE representative had called to determine the duration of his term. Mrs. Schumacher was informed that everything had been taken care of but later received that Demand notice.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Consider the untimely waiver request.

Suspend all based on future compliance.
