RE:
Request that the Board waive the $2,000.00 and $2,500.00 campaign finance late fees ($4,500.00 total) assessed against Aylin Acikalin Maklansky, an unsuccessful candidate for Council Member, District A, Orleans Parish in the October 14, 2017 election, whose 2022 Supplemental campaign finance disclosure report was filed 734 days late, AND an unsuccessful candidate for Judge, 1st City Court, Section B, Orleans Parish in the July 11, 2020 election, whose 2022 Supplemental Campaign Finance Disclosure Report was filed 734 days late.
Facts:
Aylin Maklansky requests a waiver and states the following: Her 2021 report had the incorrect start date. She did not file reports in 2022 or 2023 because she believed there was an exception if she was not elected and did not serve in any public office during the 2023 calendar year. Her election was before 2019, and she did not receive additional contributions or make loan repayments. Ms. Maklansky submitted a letter mentioning this information for 2023. She has not had any campaign staff since 2020.

Ms. Makalansky dropped out of the election during COVID-19, and as a single parent with two school-aged kids, she had to home school them. Her son almost died in May 2020 after being diagnosed with diabetes. Ms. Maklansky lost her job in the summer of 2023 and opened her law practice. Her reports have since been submitted and/or amended. She has made every effort to comply.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.
LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.
Recommendations:
Reduce fee for report for 2017 election to $600 based on Rule 1205C; decline to waive. Reduce fee for report for 2020 election to $1,000 based on Rule 1205C; decline to waive.
