Waiver request submitted by Mr. Aaron C Williams, former member of the St. Tammany Parish Recreation District #7, regarding a $1500 late fee assessed for filing his 2022 Tier 2.1 annual pfd 35 days late.
Facts:
Aaron C. Williams submitted the disclosure but has been unable to get his ex-wife to provide her income. His divorce has been less than civil, and he does not anticipate his wife cooperating without being held financially responsible. Mr. Williams faithfully and honorably served as Chair of Recreation District 7 for two years, donating several hundred hours. The District has made changes to ensure compliance. Mr. Williams prides himself on doing things properly and regrets that he cannot comply. This is also his first time filing late. He has filed for bankruptcy due to his divorce, which inhibits his ability to pay the fine. Initially, Mr. Williams attempted to submit this waiver on 10/24/2024, but due to his lack of knowledge of technology, it did not go through, preventing him from being able to prove it. After being made aware by a BOE representative, he immediately submitted the waiver request.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Consider the untimely waiver request.

Suspend all based on future compliance.
