Waiver request submitted by Jamie L. Barney, Ph.D., State Board of Social Work Examiners, regarding a $1500 late fee assessed for filing her 2022 Tier 2.1 annual pfd 245 days late.
Facts:
Jamie L. Barney gave birth on 3/17/2023, and the original due date is within 60 days of giving birth. Ms. Barney separated from her husband three months before giving birth, which led to her stepchildren leaving as well. She was left to care for her 3-year-old with special needs and a newborn. Ms. Barney also had to return to full-time employment on 5/15/2023. When the FTF notice was delivered, her family was back at home, but she was still struggling to manage duties due to postpartum depression, anxiety, and sleep deprivation. Please reduce or waive this fine due to the reasons listed and financial hardship. She mentions that she was sued, and her savings were depleted, so she had to take out a loan to settle the lawsuit. Her son was hospitalized and had to undergo two surgical procedures in May 2024, with out-of-pocket expenses that she is currently paying.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
