Untimely waiver request submitted by Stacy Marie Tinsley, Commission for Women of Bossier City, regarding a $750 late fee assessed for filing her 2023 Tier 2.1 annual pfd 15 days late.
Facts:
Stacey Marie Tinsley believed she submitted the disclosure until she received a notice. It was filed within two days of being notified of the delinquency. The green card slip is marked "agent," so that would suggest someone else signed. Instead of a note being left instructing Ms. Tinsley to retrieve the notice from the post office, the notice was left in the mailbox, which is not standard procedure for certified mail. Mail is also frequently misdelivered at her apartment complex. Ms. Tinsley relies on electronic communication and does not check her physical mail regularly, which resulted in her being unaware of the notice delivery until much later. She has a modest income as a journalist, and this fine presents a significant financial hardship. Ms. Tinsley appreciates any leniency and assistance offered in this matter.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Consider untimely waiver.


Suspend all based on future compliance.
