Waiver request submitted by Joey Strickland, former Department Secretary of Veteran Affairs, regarding a $12500 late fee assessed for filing his 2023 Tier 1 annual pfd 100 days late.
Facts:
Joey Strickland states that serving as Secretary of Veterans Affairs has been an honor. He has never had any issues with the BOE. Mr. Strickland did not receive the delinquency notice or the LFO mailed on 10/11/2024. During his 30 years of military service, he has always strived to do the honorable thing, including his 20 years in state government. Mr. Strickland retired from state service in December 2023. In late fall 2023, his mother-in-law became ill with stage 4 throat and lung cancer with constant treatment trips in New Orleans, LA, and other treatment facilities. In late February, she passed away. In March 2024, he was informed that he needed to undergo shoulder replacement surgery. This fine would be a hardship since he is retired and a 100% disabled veteran.

Law:
La. R.S. 42:1124A requires the following persons shall annually file a financial statement as provided in this Section:
(2) The secretary of each of the following departments of state government:
(l) The Department of Veterans Affairs.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.


Recommendations:
Suspend all but $2500 based on future compliance with the Code of Ethics. The $2500 is payable within 20 days and if payment is not received within 20 days, the full amount of the late fee becomes due and owing.
