Waiver request submitted by Michael D. Vicari, former member of the Naval War Memorial Commission, regarding a $1500 late fee assessed for filing his 2022 Tier 2.1 annual pfd 103 days late.
Facts:
In January 2019, Michael D. Vicari emailed his resignation to the Naval War Memorial Commission Board Chairman. He did not respond, but he reiterated in a brief phone conversation. Mr. Vicari did not receive any further notifications regarding his obligations on the Board. In March 2020, he was placed on orders in support of COVID-19 operations for the Louisiana Army National Guard. He was deployed to Iraq from November 2020 to November 2021. After receiving the FTF notice in 2023, he contacted the LBOE to explain and was told the matter would be investigated. He later received late fees. His deployment and lack of communication from the Naval War Memorial Commission during this time were beyond his control. Please waive the late fee.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Rescind all late fee orders regarding his 2019 through 2023 PFDs.
