Advisory opinion request submitted on behalf of Sen. Adam Bass regarding his renewal application as a Public Tag Agent.
Facts:
Adam Bass was elected as Senator - District 36 in 2023. He took office on January 8, 2024, with his current term ending on January 10, 2028.

Sen. Bass is the owner of North LA Tag LLC, which is an authorized public tag agent with the State of Louisiana pursuant to La. R.S. 47:532.1. Tag agents collect vehicle registration license fees, as well as applicable sales and use taxes, to issue registration certificates and license plates to vehicles and motor vehicles. Sen. Bass was approved as a public tag agent prior to his election as Senator. The renewal as a tag agent occurs every other year and requires him to submit a renewal application along with a $600 fee.
Comments:
Sen. Bass previously withdrew this request at the meeting on January 10, 2025, to receive guidance on the renewal process. Sen. Bass asked that the Board consider the request at this time.
Law:
La. R.S. 42:1113D(1(a)(i) provides that no legislator or any legal entity of such a person shall enter into any contract with state government.


La. R.S. 42:1113D(1)(a)(iii) defines "legal entity of person" as any legal entity in which the legislator owns an interest greater than 5%.

La. R.S. 42:1113D(1)(a)(v) defines "state government" to include any branch, agency, department, or institution of state government.

La. R.S. 42:1113D(1)(c) provides that the following shall not be considered a contract for purposes of this Section:
...


(v) Applying for, payment of fees for, or obtaining a license, credential, or permit provided that such license, credential, or permit is available to similarly situated person.
....
(ix) Any transaction valued at two thousand dollars or less.
