Request that the Board waive the $1000.00 campaign finance late fee assessed against Scott Leehy, a successful candidate for District Judge, 4th Judicial District Court, ES2, Div.A in the September 30, 2006 election, whose 2024 Supplemental campaign finance disclosure report was filed 62 days late.
Facts:
Scott Leehy requests a waiver and states the following: He is 62 and has served nearly 30 years in office. He believes in the rule of law and respects the work of the Board of Ethics. Mr. Leehy believed he submitted his report in January when he received the annual notice. He realizes that he filed the SUPP 2023 instead. Mr. Leehy takes full responsibility for this oversight and understands the importance of compliance. He did not have any activity this year and is not campaigning for any elective office, so there was no harm to the public or any potential candidate. If the Board determines that a waiver is inappropriate in this case, he is willing to write off his campaign debt of $12,000 and close out his campaign debt in place of the late fee assessment.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.

Recommendations:
Reduce to $600 based on Rule 1205C; decline to waive.
