Untimely waiver request submitted by Nino V. Covington, former member of the St. Tammany Fire District / District 12, regarding a $1500 late fee assessed for filing his amended 2021 Tier 2.1 annual pfd 577 days late.
Facts:
Nino Covington's wife was experiencing medical issues, which led to major surgery in May 2023. They were also finalizing construction on their new house, which was due for completion on 5/19/2023, while preparing to move. The financial documents needed to complete the disclosure were stored in boxes and not readily available. He did not respond to the LFO Amendment because the financial records had been misplaced during the move, and he would probably need to request them from his former employer. He received those documents on 11/13/2024.

Additionally, he had to travel to Monroe, LA, on 10/27/2024 to care for his 87-year-old mother, who was completing chemotherapy and undergoing tests to have surgery on 10/28/2024. Mr. Covington would like to apologize for not responding on time.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Decline to consider the untimely waiver.

In the alternative, if the Board votes to consider the untimely waiver, staff recommendation is to decline to waive.
