Waiver request submitted by Phyllis M Mendoza, former member of the Assessors' Retirement System Board, regarding a $250 late fee assessed for filing her 2023 Tier 2.1 annual pfd 5 days late.
Facts:
Katherine F. Bertrand is submitting a waiver on behalf of Phyllis M. Mendoza. Ms. Mendoza is 84 years old and has served as a trustee on the LARF Board from 1/1/2012 to 5/17/2023 as a retiree representative. Upon her nomination and election, she has always been very dedicated to attending meetings, obtaining required education credits, and filing disclosures. Following some health issues in 2021 and 2022, Ms. Mendoza could not participate in quarterly meetings in Baton Rouge since she needed someone to drive her from New Iberia. She did not realize any documentation needed to be submitted, and cognitive issues may have contributed to this oversight. She could only attend one meeting for 2022 and 2023 before resigning on 5/17/2023. Also, she only receives retirement benefits. This is Ms. Mendoza's first assessed late fee.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance.
