RE:
Advisory opinion request regarding whether the Code of Governmental Ethics ("Code") prohibits Nichole Gaubert, the Public Safety Grants and Administration Director for Jefferson Parish Government, from seeking secondary outside employment in the private sector writing grants.
Facts:
In Nichole Gaubert's position as Director, she is responsible for managing the FEMA Public Assistance grants program as well as pre-award grant assistance for various parish departments. She would like to accept some part time project-based consulting work in the public/private grant and/or emergency grant management grant consulting industry on out of state projects only. They would not have any relation to any Louisiana grant application which your department is working on. As the Director, she provides, but is not limited to providing, the following services: she supervises and oversee all project management; she provides oversight for the FEMA Public Assistant Grants Program; and, she assists the Parish in researching and applying for grant funding for infrastructure, preparedness, and recovery programs. However, she does not provide consulting services on private grants in her public position.
Law:
La. R.S. 42:1111C(1)(a) No public servant shall receive any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.

La. R.S. 42:1102(2)(a)(vi) defines "agency" to mean, for public servants of political subdivisions, it shall mean the agency in which the public servant serves, except that for members of any governing authority and for the elected or appointed chief executive of a governmental entity, it shall mean the governmental entity.

La. R.S. 42:1102(18)(a)(ii) defines "public employee' as any person who is appointed by any elected official when acting in an official capacity, and the appointment is to a post or position wherein the appointee is to serve the governmental entity or an agency thereof, either as a member of an agency, or as an employee thereof.

La. R.S. 42:1102(19) defines "public servant" to mean a public employee or elected official. her organizational unit of a governmental entity.

Recommendations:
Adopt draft advisory opinion.
