RE:
Request that the Board waive a $1,000 fee and a $360 fee ($1,360 total) assessed against Kristopher J. Harrison, a disqualified candidate for State Senator, 23rd Senatorial District in the February 15, 2025 election, whose 30-P and 10-P reports were filed 49 days and 8 days late, respectively.
Facts:
Kristopher Harrison requests a waiver and states the following: He is a former candidate for the Louisiana State Senate for District 23. He lives with his parents while pursuing an M.A. and works at a local grocery store. Aware of his limited finances, he still decided to run for state senator and planned to rely on his wages and donations. His campaign was at a standstill because a third party objected to his candidacy since his 2019 and 2022 Louisiana State taxes were not filed under state law. Mr. Harrison went to court and was ordered to disqualify on a technicality. In 2022, he filed his taxes, and for unknown reasons, his state return did not go to the Louisiana Department of Revenue and was not listed as filed. Since Mr. Harrison was disqualified, he believed he didn't need to file the CF report until he received the delinquency notice.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.

Recommendations:
With respect to 30-P, reduce to $600 based on Rule 1205C, decline to waive.

With respect to 10-P, decline to waive.
