| Advisory opinion request on behalf of The St. Martin Parish Sheriff's Office and the approval of the disqualification plan under the Code of Governmental Ethics ("Code") for Charles Fuselier Jr., Special Operations Sergent and his daughter, Staci Fuselier Louviere. |

Staci Fuselier Louviere is the biological daughter of Charles Fuselier Jr. Charles Fuselier Jr. is Special Operations Sergent in the Patrol Unit. Staci Fuselier Louviere is a full-time employee in the Investigation Unit. Both Patrol Unit and Investigation Unit fall under the Enforcement Division. Given the current positions of both parties, they will be unlikely to work together, however, there is always a possibility. If a situation occurs, a disqualification plan has been submitted for approval.
Disqualification Plan
Sgt. Charles Fusilier will be disqualified and excluded from any decisions and/or approvals required by the St. Martin Parish Sheriff's Office that affect the employment, salary and/or any economic interest of Staci Fuselier Louviere that would violate La. R.S. 42:1112. If this occasion presents itself, all decisions shall be made by the Sheriff or an individual appointed by the Sheriff to make such decision.

La. R.S. 42:1112B(1) provides that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.
La. R.S. 42:1112C allows a disqualification plan to be developed in accordance with rules adopted by the Board to remove a public servant from participating in transactions that would otherwise present violations of Section 1112 of the Code.
La. R.S. 42:1119A provides that no member of the immediate family member of an agency head shall be employed in his agency.
La. R.S. 42:1102(2)(a)(i) defines "agency" for as the office, division, agency, commission, board, committee, or other organizational unit of a governmental entity.
La. R.S. 42:1102(3) defines "agency head" to mean the chief executive or administrative officer of an agency.
La. R.S. 42:1102(13) defines "immediate family" to include a public servant's mother -in-law.
