Waiver request submitted by LaVerne (Dr.) Cook, Jr., Member of School Board / District 2 / Bogalusa City / Washington Parish, regarding a $100 late fee assessed for filing his amended 2023 Tier 3 annual pfd 4 days late; AND, a $500 late fee assessed for filing his 2025 School Board Disclosure 10 days late.
Facts:
In addition to responsibilities as a Bogalusa City Schools District Board Member, Laverne Cook served as the Trumph Missionary Baptist Church Pastor. During that busy period, his assistant inadvertently misplaced the necessary documentation, resulting in a delayed submission. Mr. Cook would like to apologize for any inconvenience this may have caused. He takes his filing responsibility seriously and has always made every effort to comply. Please consider waiving the assessed late fee.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

School Board Law:

La. R.S. 42:1119B(2)(a)(iii) by September fifteenth of each school year, any school board member or superintendent whose immediate family member is employed by the school board shall file a disclosure statement with the Board of Ethics stating the facts of such employment. Any person who fails to timely file a disclosure statement under this Item may be assessed a late fee of fifty dollars per day, not to exceed one thousand five hundred dollars, subject to the provisions of R.S. 42:1157.
