Advisory opinion regarding whether the Code of Governmental Ethics prohibits Claudia Armwood from accepting a teaching position with the East Baton Rouge Parish School System while her half-sister is a member of the school board and she holds a Out-of-Field Authorization to Teach Certificate (OFAT).
Facts:
Claudia Armwood's half-sister is an elected member of the East Baton Rouge Parish School Board. Ms. Armwood is a certified school counselor who also holds a Out-of-Field Authorization to Teach. She would like to accept a 9 month teacher position as Scotlandville Magnet High as a virtual teacher working physically on the campus. She would also like to work as the summer school teacher for the virtual summer program for the month of June at Scotlandville Magnet High.
Law:
La. R.S. 42:1119B provides no member of the immediate family of a member of a governing authority or the chief executive of a governmental entity shall be employed by the governmental entity. (2) Notwithstanding the provisions of Paragraph (1) of this Subsection: (a)(i) Any local school board may employ any member of the immediate family of any board member or of the superintendent as a classroom teacher provided that such family member is certified to teach or is temporarily authorized to teach while pursuing certification.
Recommendations:
Adopt proposed advisory opinion.
