RE:
Request for approval of a Disqualification plan regarding the employment of the son of the EMS Supervisor at Station 19 with the Shreveport Fire Department working at a Station at which his father serves as the EMS Supervisor.
Facts:
An Advisory Opinion was rendered in Docket No. 2025-641 determining that the transfer of Terrance Davis, Jr. to a station in which his father, Terrance Davis, Sr., was assigned to as an EMS Supervisory was permissible. Mr. Terrance Davis, Sr. is now submitting the following disqualification plan regarding matters involving his son: Terrance Davis, Sr. shall not be involved in any disciplinary action, EMS Investigation, promotion, evaluation, or economic decision involving Terrance Davis, Jr. All such matters shall be reassigned to alternate command staff or supervisors within the established chain of command.

  1. For Non-EMS Disciplinary Issues, if the matter involves Terrance Davis, Jr., the B-Shift Assistant Chief, Tommy Carpenter, shall assign the case to alternate supervisor within the chain of command.
  2. For EMS Complaints or Investigations, if the matter involves Terrance Davis, Jr., the case should be reassigned to an alternate EMS supervisor Car82/Car83 (Captain Eric Stacy or a future appointee).
  3. Terrance Davis, Sr. shall not be involved in any matters concerning promotional processes, pay, incentives, compensation decisions, specialty assignments, evaluations, performance reviews, or any action involving financial benefit or career advancement regarding Terrance Davis, Jr.


Law:
La. R.S. 42:1112B(1) states that no public servant, except as provided in R.S. 42:1120, shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.

La. R.S. 42:1112C allows a disqualification plan to be developed in accordance with rules adopted by the Board to remove a public servant from participating in transactions that would otherwise present violations of Section 1112 of the Code.

Recommendations:
Approve the proposed disqualification plan.
