Advisory Opinion regarding whether the Code of Governmental Ethics prohibits a member of the Coulee Croche Fire Protection District 4 Board from being appointed to the position of Fire Chief of the District.
Facts:
A sitting board member of the Coulee Croche Fire Protection District 4 ("District") is interested in being appointed to the position of Fire Chief of the District, which is a volunteer position. If appointed as Fire Chief, the board member would be voting on agenda items that directly affect himself and his firefighters.
Law:
La. R.S. 42:1113B provides that no appointed member of any board or commission, member of his immediate family, or legal entity in which the appointed member has a substantial economic interest shall bid on, enter into, or have a substantial economic interest in any contract, subcontract, or other transaction which is under the supervision or jurisdiction of the agency of such appointed member.

La. R.S. 42:1123(1) provides an exception for participation in the affairs of charitable, religious, nonprofit education, public service, or civic organizations when no compensation is received.

Recommendations:
Decline to render an advisory opinion.
