Advisory opinion request from the Bogalusa Chief of Police regarding whether the Code of Governmental Ethics prohibits the Bogalusa City School District from paying an officer for providing special security details to Bogalusa City Schools while the officer's mother serves on the Bogalusa City School Board.
Facts:
The City of Bogalusa employs Damon Mitchell as an officer with the Bogalusa Police Department. Officer Mitchell serves as a school resource officer for the Bogalusa City School District ("School District"). Currently, the City of Bogalusa compensates Officer Mitchell for his services, and the School District reimburses the City of Bogalusa for the services provided by Officer Mitchell, due in part to the fact that Officer Mitchell's mother, Catherine "Cathy" Mitchell, is an elected member of the Bogalusa City School Board ("School Board").

On certain occasions, Officer Mitchell, as well as other officers with the Bogalusa Police Department, provide special security details for Bogalusa City Schools, for which the School District compensates the officers.

Law:
La. R.S. 42:1113A(1)(a) states no public servant, excluding any legislator and any appointed member of any board of commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.


La. R.S. 42:1161A provides that every agency head shall file confidential reports with the board or panel on any matters that come to his attention which he believes may constitute a violation of this Chapter which is within the board or panel's jurisdiction.

Recommendations:
Adopt the proposed advisory opinion.
