Stutes, Jr., on behalf of the City of Lake Charles (the "City") and the members of the Lake Charles City Council (the "City Council") as to whether the Louisiana Code of Governmental Ethics (the "Code") permits the City and the City Council to act with respect to matters that may have involved a suspected violation of the Code. |

The City and the City Council are considering proposals regarding designating the City as a Medicaid taxing authority for local hospitals. The former mayor of the City, Mr. Nic Hunter, has been involved in this process on behalf of Lake Charles Memorial Hospital.

La. R.S. 42:1161A provides that every agency head shall file confidential reports with the board or panel on any matters that come to his attention which he believes may constitute a violation of this Chapter which is within the board or panel's jurisdiction. LAC 52:601 provides that the Board of Ethics shall receive requests for advisory opinions filed with it by affected persons. LAC 52:101 defines "affected person" to mean any person or governmental agency, or the authorized representative of such person or agency with a demonstrable and objective interest in the board's interpretation, construction, and application of any law within the board's jurisdiction.
