Advisory Opinion regarding whether the Code of Governmental Ethics prohibits participation by the Town Clerk of Benton in matters involving the Police Department while her husband is the Police Chief.
Facts:
Tiffany Manning is on the Town Council for the Town of Benton. She has requested an advisory opinion as to whether there is a conflict of interest between the current town clerk, Stephanie Collier and Mrs. Collier's husband, Steve Collier, who is the Chief of the Police. Ms. Manning states that Mrs. Collier has worked for the Town for several years prior to her husband being employed as Chief of Police.
Law:
Rule 601 of the Rules for the Louisiana Board of Ethics provides that the Board shall receive requests for advisory opinions filed with it by "affected persons." Further, Rule 601 provides that the Board may decline to render an opinion with regard to any such request. Rule 101.B defines "affected person" to mean any person or governmental agency, or the authorized representative of such persons or agency with a demonstrable and objective interest in the Board's interpretation, construction, and application of any law within the Board's jurisdiction.
Recommendations:
Decline to render an advisory opinion.
