Advisory opinion request regarding whether the Code of Governmental Ethics prohibits the employment of the child of an employee of the State Board of Social Worker Examiners.
Facts:
Regina Dewitt is an Administrative Assistant at the Louisiana State Board of Social Work Examiners ("LSBSWE"). She was approached by her Administrator asking if her daughter, Ava Breaux, would be interested in applying for a part-time student worker position. Ms. Dewitt states that she is not the head of the agency, she currently does not not serve in any supervisory capacity, and would not have supervisory power over her daughter. Ms. Breaux would be hired through standard procedures.
Law:
La. R.S. 42:1119A provides that no member of the immediate family of an agency head shall be employed in his agency.



La. R.S. 42:1102(3) defines "agency head" to mean the chief executive or administrative officer of an agency or any member of a board or commission who exercises supervision over the agency.

La. R.S. 42:1102(13) defines "immediate family" as the term relates to a public servant to mean his children, the spouses of his children, his brothers and their spouses, his sisters and their spouses, his parents, his spouse, and the parents of his spouse.

Recommendations:
Adopt the proposed advisory opinion.
