Advisory Opinion request regarding whether the Code of Governmental Ethics prohibits a spouse of the Clerk of Court for Lafayette City Court from operating a sober living home for 15th JDC drug court participants who may also have matters in City Court.
Facts:
Kelly Mouisset is Clerk of Court for City Court of Lafayette. Her husband and a non-relative business partner are in the process of forming a company for the purpose of purchasing and operating a commercial rental property to be used as a sober living home, which is expected to receive referrals primarily from the 15th JDC Drug Court Program. Residents' rent will be funded either directly by program participants or through Louisiana DOJ. Kelly Mouisset is not employed by the 15th JDC, which has its own elected Clerk of Court and administrative structure. Lafayette City Court does not refer individuals to drug court programs or sober living homes and does not handle drug offense. However, it is possible that a resident of the sober living home may have unrelated matters pending or arise in City Court.
Recommendations:
Adopt proposed Advisory Opinion.
