| Advisory Opinion Request from John Fleming, Treasurer of the State of Louisiana, as to whether the Code of Governmental Ethics (the "Code") prohibits the execution of a Cooperative Endeavor Agreement between the Department of the Treasury (the "Treasury Department") and the St. Tammany Parish Development District. |

The Treasury Department is required to enter into cooperative endeavor agreements with recipients of line-item appropriations made by the state legislature. Pursuant to this requirement, the Treasury Department would like to enter into a cooperative endeavor agreement with the St. Tammany Parish Development District (the "Proposed CEA"). Under the terms of the Proposed CEA, certain funds will be allocated to Colliers Strategy and Consulting, Inc. (the "Company"). Chris Abadie is a real estate broker with the Company. Mr. Abadie is currently serving as a member of the First Planning District Workforce Development Board. There is no known connection between the Proposed CEA and the First Planning District Workforce Development Board.

La. R.S. 42:1117 provides that no public servant or other person shall give, pay, loan, transfer, or deliver or offer to give, pay, loan, transfer, or deliver, directly or indirectly, to any public servant or other person any thing of economic value which such public servant or other person would be prohibited from receiving by any provision of this Part. La. R.S. 42:1102(15) defines "person" to mean an individual or legal entity other than a governmental entity, or an agency thereof.
