RE:
Request from Courtney Fontaine to waive the $500 late fee for filing her 2026 lobbying registration 47 days late and the $1,500 fee for filing her 2022 supplemental registration 1,535 days late.
Facts:
Affidavit received from Conor Kelly, Counsel to Institute for Justice, requesting a waiver regarding late fees assessed to Courtney Fontaine for past due reports for 2025. Mr. Kelly states, the 2025 reports were not timely filed due to unforeseen staffing circumstances within his office. The staff member responsible for preparing and submitting lobbying reports became suddenly ill requiring bypass surgery and was unable to perform the duties. The staff member did not return to work and is now retired on disability. As a result, his office experienced an unexpected and severe disruption and was required to reassign responsibilities and bring other personnel up to speed regarding pending lobbying filings and requirements.

Law:
R.S. 33:9666 and 33:9668 provide that "[e]ach lobbyist shall register with the ethics board as soon as possible after employment as a lobbyist or after the first action requiring his registration as a lobbyist, whichever occurs first, and in any event not later than five days after employment as a lobbyist or not later than five days after the first action requiring his registration as a lobbyist, whichever occurs first.
Recommendations:
Waive the $500 late fee for the 2026 Registration. Rescind the $1,500 late fee for the 2022 Supplemental Registration.
