RE:
Advisory opinion request regarding whether the Code of Governmental Ethics prohibits a nonprofit organization operated by an employee of LSU Veterinary Medicine from entering into transactions with the LSU Ag Center.
Facts:
Krista Adams is currently employed as Program Manager for the Division of Laboratory Animal Medicine within the LSU School of Veterinary Medicine, which is a department of the LSU AgCenter. Her duties do not involve grant administration, procurement, or decision-making authority.

Ms. Adams also serves, without compensation, as Director of Purple Martin Conservation Initiative, Inc. ("PMCI"), a nonprofit organization dedicated to Purple Martin conservation and environmental education. PMCI is considering establishing a paid conservation internship funded by non-state and non-federal sources and, if funding is received, intends to enter into an agreement with LSU AgCenter under which PMCI would provide funding to the School of Renewable Natural Resources to administer and employ the intern in accordance with its policies and procedures.

Ms. Adams would receive no personal or business benefit from the agreement, and any compensation would be paid solely to the intern for services performed by them. Ms. Adams would have no involvement in the selection of the intern or the assignment or performance of their work.

Law:
La. R.S. 42:1113A(1)(a) provides that no public servant, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt proposed advisory opinion.
