Kathleen Sullivan is the Founder and Head of School at Jefferson Rise Charter School ("the School"), and she is considered the agency head for purposes of the Code of Governmental Ethics ("the Code"). Zachary Moss has worked at the School since July of 2019 and has served in his current position as Director of Culture and Operations since July of 2020. Ms. Sullivan and Mr. Moss were married in June of 2021 and have, since April 2021, abided by the disqualification plan approved in Ethics Board Docket No. 2021-106.
Under the 2021 disqualification plan, the assistant principal Trent Mackey was responsible for the supervisory and disciplinary decisions concerning Mr. Moss, and Mr. Moss reported to him on employment issues. While Ms. Sullivan and Mr. Moss remain employed at the School in the above-described capacities, Mr. Mackey has left his position.
Pursuant to Mr. Mackey's departure, Mr. Moss will now report to the school's Board of Directors rather than to Mr. Mackey or the new vice principal, and the Board of Directors will assume the supervisory and disciplinary responsibilities previously held by Mr. Mackey with regard to Mr. Moss. Specifically, Ms. Sullivan will be disqualified from any action regarding Mr. Moss's salary or benefits, discipline or reprimand, leave, promotions, demotions, and any other actions, approvals, or authorizations concerning his employment and benefits; and the School's Board of Supervisors will be responsible for these decisions. Further, Mr. Moss will report to the Board of Directors concerning any issues he may have with his employment at the School, and Ms. Sullivan will report to the School's Board Chair any issues she may have with Mr. Moss as an employee of the School.

La. R.S. 42:1112B(1) provides that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest. La. R.S. 42:1112C allows a disqualification plan to be developed in accordance with rules adopted by the Board to remove a public servant from participating in transactions that would otherwise present violations of Section 1112 of the Code. La. R.S. 42:1119A provides that no member of the immediate family of an agency head shall be employed in his agency.
