Advisory opinion request regarding whether the Code of Governmental Ethics prohibits a company owned by the Code Enforcement Officer and Chief Building Official for the City of Opelousas from contracting with the Opelousas Housing Authority.
Facts:
Lance Ned is the Code Enforcement Officer and Chief Building Official for the City of Opelousas. He is a Louisiana-licensed commercial contractor and the owner of Recovery Resources Treatment Services, LLC ("RRTS").

The Opelousas Housing Authority is a separate entity from the City of Opelousas. Mr. Ned and his office do not provide any services to, for, or on behalf of OHA in his official capacities with the City of Opelousas. Furthermore, the OHA is overseen by the federal HUD office and governed by a local board of commissioners, of which board Mr. Ned is not a member.

Law:
La. R.S. 42:1113A(1)(a) prohibits public servants, or members of such a public servants' immediate family, or legal entities in which the public servant has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt proposed Advisory Opinion.
