Request that the Board waive $1,000 campaign finance late fee assessed against Terence Vinson, an unsuccessful candidate for State Representative, 2nd Representative District in the October 24, 2015 election, whose 2025 Supplemental campaign finance disclosure report was filed 112 days late.
Facts:
Terence Vinson requests a waiver and states the following: He mistakenly believed that after five years, the filing requirement had ended. He has since learned that if a candidate is in office, supplemental reports must be filed. Mr. Vinson regrets this misunderstanding and has taken steps to ensure it does not happen again. There are no funds in the campaign account, and the only outstanding balance is the amount he loaned to the campaign. No contributions or expenditures occurred that would have provided a financial benefit or lack of transparency. Mr. Vinson is unemployed, and this fine would create a financial hardship. He acknowledges his responsibility for this misunderstanding and appreciates your consideration of this matter. Please waive the assessed late fee.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.

Recommendations:
Reduce to $600 based on Rule 1205C; suspend all but $200 based on future compliance.
