RE:
Advisory opinion request regarding whether the Code of Governmental Ethics prohibits the employment of the daughter of the Chief of Administration for the Kenner Fire Department with the Kenner Fire Department.
Facts:
Jason Dyer is the Chief of Administration for the Kenner Fire Department. In this capacity, he serves as second in command and oversees the administrative functions, including personnel administration, budgeting, fleet management, communications, and other operational responsibilities. Mr. Dyer routinely participates in the hiring process by conducting interviews and providing recommendations for hiring to the Fire Chief.

Mr. Dyer's daughter would like to apply for the Communications Officer position. This position reports to the Communication Supervisor, who in turn reports to Mr. Dyer.

Law:


La. R.S. 42:1119A states that no member of the immediate family of an agency head shall be employed in his agency.

La. R.S. 42:1102(3) defines "agency head" to mean the chief executive or administrative officer of an agency or any member of a board or commission who exercises supervision over the agency.

Recommendations:
Adopt proposed advisory opinion.
