Leon <br /> Deputy CAO, City of Kenner <br /> 1801 Williams Blvd <br /> Bldg B, Ste 200 <br /> Kenner, LA 70062 <br /> Re: Ethics Board Docket No. 2016-026 <br /> Dear Ms. Leon: <br /> The Louisiana Board of Ethics, at its March 18, 2016 meeting, considered your request <br /> for approval of a disqualification plan, submitted on behalf of the City of Kenner (City), <br /> involving the continued employment of Barry Sprague, a Systems Specialist in the <br /> Information Technology Department (Department), at a time when his brother, Jay <br /> Sprague, is employed as the Director of the Department. You stated that Jay Sprague was <br /> promoted to Director of Information and Technology in January of 2016, after having <br /> been employed with the Department as a Systems Specialist since 1997. You further <br /> stated that Barry Sprague has been employed with the Department since 2013. <br /> In connection with Barry Sprague's continued employment, you have submitted a <br /> disqualification plan on behalf of the City. Under the proposed plan, Jay Sprague will be <br /> disqualified from any and all appointing authority duties, decisions and/or approvals <br /> required by the City that directly affect the employment of Barry Sprague. Accordingly, <br /> you, as the Deputy Chief Administrative Officer for the City, will be responsible for all <br /> supervisory duties and/or authority regarding matters affecting Barry Sprague's <br /> employment, including evaluations, disciplinary actions, promotions, demotions and <br /> raises. <br /> The Board concluded, and instructed me to inform you, that the Board approves the <br /> disqualification plan, submitted on behalf of the City, by virtue of which you, the Deputy <br /> Chief Administrative Officer for the City, will have all supervisory duties and/or <br /> authority as to matters affecting Barry Sprague's employment, including evaluations, <br /> disciplinary actions, promotions, demotions and raises. La. R.S. 42:1119A prohibits a <br /> member of the immediate family of an agency head from being employed in his agency. <br /> However, La. R.S. 42:1119C allows a public employee that has been employed for at <br /> least one year prior to her immediate family member becoming the agency head to <br /> continue his employment and receive normal promotional advancements. La. R.S. <br /> 42:1112B(1) provides that no public servant shall participate in a transaction involving <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
