10. <br /> La. R.S. 42:1155 provides with respect to penalties: <br /> A. If an investigation pursuant to R.S. 42:1141 reveals that any public servant <br /> or other person has violated any law within the jurisdiction of the board to his <br /> economic advantage, the board may order the payment of penalties. <br /> Recovery may include, in addition to an.amount equal to such economic <br /> advantage, penalties not to exceed one half of the amount of the economic <br /> advantage... <br /> 11. <br /> Based on the foregoing facts,Sheila Choplin violated La.R.S.42:1111A when she took cash <br /> utility deposits, in the amount of$1,154, from the Utility Billing Department for her personal use, <br /> to which she was not duly entitled for the performance of the duties and responsibilities of her public <br /> position, at a time when she was employed with the City of St. Martinville. <br /> 12. <br /> As evidenced by her signature below, Sheila Choplin knowingly, intentionally, and of her <br /> own free will(a)agrees that the charges are factually supported by facts stated herein;(b)agrees that <br /> she viol4ted La.R.S.42:1111A as described above;(c)waives her right of appeal;(d)acknowledges <br /> that,upon her signature being affixed to this consent decree,this document will be available to the <br /> public as a public record;(e),agrees that this order and decree is final,waives her right of appeal or <br /> to otherwise seek a return of the payment as the penalty;and(f)agrees to comply with any other term <br /> or,condition in the following order and decree. <br /> Page 3 of 6 <br />
