Advisory opinion that the Louisiana Code of Governmental Ethics would not prohibit an elected member of the Terrebonne Parish Council from continuing her employment with Gilsbar, LLC., at a time when it has a contract of insurance with the Parish since she meets the exception created in Board Docket No. 82002D; however, she would be prohibited from voting on matters in which Gilsbar, LLC., has substantial economic interest, at a time when she is employed with Gilsbar. The councilwoman may participate in the debate or discussion concerning the matter involving Gilsbar, provided she discloses her conflict or potential conflict on the record of the Council prior to her participation in the debate or discussion and prior to the vote. Finally, she would be prohibited from monitoring employee health insurance claims for the Parish, administering group health benefit enrollments for new Parish employees, or performing any other duties on behalf of Gilsbar, pursuant to its contract of insurance with the Parish.

Williams, regarding whether <br /> Mrs. Williams, as an elected member of the Terrebonne Parish Council (Council), may <br /> participate in transactions in which Gilsbar, LLC, has a substantial economic interest. <br /> Additionally, you asked for an advisory opinion regarding whether Mrs. Williams may <br /> continue her employment with Gilsbar, LLC, at a time when it has a contract of insurance <br /> with the Terrebonne Parish Consolidated Government (Parish). If so, you asked whether <br /> Mrs. Williams is required to file disclosure statements, in accordance with La. R.S. <br /> 42:1114A. You provided the following background information for consideration in <br /> connection with your request: <br /> The Council approves the selection of insurance agents by ordinance and insurers by <br /> resolution based upon a majority of Council membership voting. The Parish recently <br /> solicited proposals from agents of record and insurers for group health insurance <br /> coverage for its employees, including medical, dental and pharmacy benefits. A risk <br /> management insurance committee, appointed by the Parish's Administration, vetted the <br /> proposals and narrowed the choices down to three companies and their respective agents: <br /> 1) Blue Cross/Blue Shield, brokered by South Louisiana Financial Services, LLC, or <br /> Laris Insurance Agency, 2) Gilsbar, LLC, brokered by Anthony J. Alford Insurance <br /> Corporation, and 3) United Healthcare Services, Inc., brokered by South Louisiana <br /> Financial Services, LLC, or Laris Insurance Agency. The risk management insurance <br /> committee presented the three proposals to the Council's Policy and Procedure <br /> Committee (Committee), which is made up of the entire 9-member Council, at its <br /> meeting on November 14, 2016, to which the agents were invited to present their <br /> proposals. The Committee was tasked with choosing a group health insurance provider <br /> and its agent of record at the Committee meeting. <br /> Mrs. Williams is also a full-time employee of Gilsbar, LLC, as a Heath and Claims <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
