"Knowing and <br /> willful"means conduct which could have been avoided through the exercise of due diligence. <br /> 5. <br /> Based on the foregoing facts, Jerome Richard used approximately $37,000 in campaign <br /> funds for his personal use in violation of La. R.S. 18:1505.2I(1). <br /> 6. <br /> Jerome Richard failed to disclose or accurately disclose contributions accepted and <br /> expenditures made totaling approximately $37,000 related to his personal use of his campaign <br /> funds on campaign finance disclosure reports. <br /> 7. <br /> La. R.S. 18:1495.5B(2) provides that a candidate shall disclose the total of all <br /> contributions received and accepted by the candidate during the reporting period. <br /> 8. <br /> La. R.S. 18:1495.5B(4) requires that each report contain the full name and address of <br /> each person who has made a contribution which has been received and accepted by the candidate <br /> during the reporting period. <br /> 9. <br /> La. R.S. 18:1495.5B(11) provides that a candidate shall disclose the total of all <br /> expenditures made by the candidate during the reporting period. <br /> 10. <br /> La.
