III. <br /> FINDINGS OF FACT: <br /> 1. <br /> The City of Franklin was incorporated on April 15, 1876, under the provisions of a <br /> special charter. On August 1, 2004, the City of Franklin adopted a Home Rule Charter <br /> and operates under an elected Mayor-Council, administrative-legislative form of <br /> government. The City's operations include police and fire protection, streets and <br /> drainage, parks and recreation, residential waste collection services, certain social <br /> services and general and administration services. The City owns and operates an <br /> enterprise fund which provides water services. The City of Franklin is a political <br /> subdivision and governmental entity as defined by La. R.S. 42:1102(12) and (17). <br /> 2. <br /> Bernard Daniels has been the Director of Utilities for the City of Franklin since <br /> July 1, 2018, and has served continuously as the Director at all times pertinent herein. <br /> 3. <br /> As the Director of Utilities for the City of Franklin, Bernard Daniels, is responsible <br /> for managing the Utility Department, which includes the Water Plant, the Sewer Plant, <br /> the Water Distribution/Sewer Collections Divisions. As the Director of the Utility <br /> Department, Bernard Daniels is the agency head as defined by La. R.S. 42:1102(3). The <br /> Sewer Collections Division is supervised by Joseph Jones, who is not related to Joseph <br /> Daniels.
