Ethics Board Docket No. 2021-346 <br /> Page 6 of 10 <br /> employee or other person,or impose a fine of not more than ten thousand dollars, or <br /> both. <br /> V. <br /> OPINION: <br /> It is the opinion of the Board that Dr. James Gilmore, Jr., while serving as an appointed <br /> member of the Baton Rouge North Economic Development District Board of Directors, violated <br /> Section 1113B, which prohibits an appointed member of any board from entering into or being in <br /> way interested in a transaction under the supervision or jurisdiction of the board of the appointed <br /> board member. <br /> The Baton Rouge North Economic Development District is a political subdivision of the state <br /> as set forth in its enabling statute,La. R.S. 33:3740.67. It is the governing authority for the District <br /> and a governmental entity as defined by Sections 1102(11)and(12)of the Ethics Code. Dr. Gilmore <br /> is an appointed member of a board by virtue of his appointment by the Mayor-President of East <br /> Baton Rouge Parish to serve as a member of the Board of Directors of the Baton Rouge North <br /> Economic Development District. As an appointed member of a board, Dr. Gilmore is a public <br /> employee and public servant as defined by the Ethics Code. As a public servant of the Baton Rouge <br /> North Economic Development District,a political subdivision of the state,Dr. Gilmore's agency is <br /> the Baton Rouge North Economic Development District as defined by the Ethics Code. As such, <br /> Dr. Gilmore was prohibited from entering into or being in way interested in a transaction under the <br /> supervision or jurisdiction of his agency, the District. <br /> Dr. Gilmore entered into and was in any way interested in his appointment to the position of <br /> Interim Executive Director, which was a particular matter that was the subject of action by the <br />
