Ethics Board Docket No. 2021-348 <br /> Page 3 of 9 <br /> 6. <br /> On January 5,2021,Tracy Wells submitted a rezoning application to the City of Hammond <br /> Zoning Commission in connection with property located at 211 S. Elm Street, seeking approval to <br /> build a duplex on the site, which required a change in zoning. <br /> 7. <br /> On February 4, 2021, the Hammond Zoning Commission held a public hearing on the <br /> rezoning application. By a 5-0 vote, the Zoning Commission recommended denial of the <br /> application as the property sits in the Iowa Addition Overlay District, which expressly prohibited <br /> duplexes. <br /> 8. <br /> On February 9, 2021, the Hammond City Council held a public meeting regarding the <br /> introduction of the Zoning Commission's recommended denial of the rezoning application. Devon <br /> Wells participated in the discussion of the item, indicating his support, but recused himself from <br /> the vote. The rezoning request was denied 4-0. <br /> 9. <br /> On February 23,2021,the Hammond City Council held a second public meeting regarding <br /> final action of the rezoning application. Devon Wells again participated in the discussion, but <br /> recused himself from the vote. The rezoning request was denied 4-0. <br /> 10. <br /> If called to testify,Tracy Wells would state that she was unaware that her conduct violated <br /> any provision of the Code of Governmental Ethics; that she did not maliciously, intentionally, or <br /> willfully violate the Code of Governmental Ethics; and transparency has been of the utmost <br />
