i <br /> Ethics Board Docket No. 2021-334 <br /> Page 5 of 12 <br /> C.(2)The provisions of this Section shall not prohibit the continued employment of <br /> any public employee nor shall it be construed to hinder, alter, or in any way affect <br /> normal promotional advancements for such public employee where a member of <br /> immediate family becoming the agency head. <br /> D. A willful violation of this Section shall subject the agency head, member of the <br /> governing authority, the public employee having authority to hire and fire the <br /> employee, the immediate supervisor of the employee, whether or not such persons <br /> are immediate family members of the employee,and such employee,to disciplinary <br /> action and penalties provided by this Chapter. <br /> 2. <br /> Section 1112 of the Code of Governmdntal Ethics prohibits a public servant from <br /> participating in transactions involving his governmental entity in which his immediate family <br /> member has a personal substantial economic interest. Section 1112B(1)provides in pertinent part: <br /> B(1) No public servant, except as provided in R.S. 42:1120, shall participate in a <br /> transaction involving the governmental entity in which,to his actual knowledge,any <br /> of the following persons has a substantial economic interest: <br /> (1)Any member of his immediate family. <br /> 3. <br /> The following terms in La.R.S.42:1102 of the Louisiana Code of Governmental Ethics are <br /> germane to analyzing the findings of fact and the applicable law. <br /> §1102. Definitions <br /> Unless the context clearly indicates otherwise,the following words and terms,when used in <br /> this Chapter, shall have the following meanings: <br /> (3)"Agency head"means the chief executive or administrative officer of an agency <br /> or any member of a board or commission who exercises supervision over the agency. <br />
