La. R.S. 42:1102(22)(a) defines "Thing of economic value" as money or any other thing having <br /> economic value. <br /> La. R.S. 42:1111(A) prohibits a public employee from receiving anything of economic value, <br /> other than compensation and benefits from the governmental entity to which he is duly entitled, <br /> for the performance of the duties and responsibilities of his office or position. <br /> La. R.S. 42:1123(2)(a) excepts awards for meritorious public contributions given by public <br /> service organizations from the Code. <br /> ANALYSIS <br /> As an employee of the Library, you are a public employee, as well as a public servant. La. R.S. <br /> 42:1102(18)(x); 1102(19). As such, La. R.S. 42:1111(A)prohibits public servants from receiving <br /> any thing of economic value for the performance of their duties and responsibilities. However, <br /> La. R.S. 42:1123(2)(a) provides that awards for meritorious public contributions given by public <br /> service organization are exceptions to the Code. Here, the award is sponsored by the Carnegie <br /> Corporation of New York, a philanthropic foundation. The I Love My Librarian Award Honorees <br /> were specifically selected for their outstanding public service accomplishments. 1123(2)(a). <br /> CONCLUSION <br /> The Board concluded, and instructed me to inform you,that based on the facts presented,the Code <br /> does not prohibit you from accepting the $5,000.00 cash prize, awarded to you as an I Love My <br /> Librarian Award Honoree. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Louisiana Code of <br /> Governmental Ethics. The Board issues no opinion as to past conduct or as to laws other than the <br /> Louisiana Code of Governmental Ethics, the Campaign Finance Disclosure Act, the Lobbyist <br /> Disclosure Act, and the conflict of interest provisions contained in the Louisiana Gaming Control <br /> Law.
