Ethics Board Docket No. 2021-751 <br /> Page 5 of 11 <br /> the Louisiana Code of Governmental Ethics. <br /> La.R.S. 17:3996B Notwithstanding any state law,rule,or regulation to the contrary <br /> and except as may be otherwise specifically provided for in an approved charter, a <br /> charter school established and operated in accordance with the provisions of this <br /> Chapter and its approved charter and the school's officers and employees shall be <br /> exempt from all statutory mandates or other statutory requirements that are applicable <br /> to public schools and to public school officers and employees except for the <br /> following laws otherwise applicable to public schools with the same grades: <br /> (20)Code of Governmental Ethics,R.S. 42:1101 et seq.,with the exception <br /> of R.S.42:1119 as it applies to any person employed by a charter school prior <br /> to August 15, 2003. <br /> Section 1119 of the Code of Governmental Ethics prohibits an immediate family of an. <br /> agency head and a member of a governing authority from being employed in such agency head's <br /> agency and governing authority member's governmental entity. Section 1119 provides narrow <br /> exceptions to the nepotism prohibitions. Sections 1119A, 1119C and 1119D of the Code provide <br /> in pertinent part: <br /> §1119. Nepotism <br /> A. No member of the immediate family of an agency head shall be employed in his <br /> agency. <br /> C.(2)The provisions of this Section shall not prohibit the continued employment of <br /> any public employee nor shall it be construed to hinder, alter, or in any way affect <br /> normal promotional advancements for such public employee where a member of <br /> immediate family becoming the agency head. <br /> D. A willful violation of this Section shall subject the agency head, member of the <br /> governing authority, the public employee having authority to hire and fire the <br /> employee, the immediate supervisor of the employee, whether or not such persons <br /> are immediate family members of the employee,and such employee,to disciplinary <br />
