In June of 2022, the United States Attorney's Office for the Western District of Louisiana charged Ms. Cooper with embezzling, stealing, and obtaining by fraud money that was under the care, custody, and control of the Cottonport Housing Authority. 7. Ms. Cooper was sentenced to imprisonment for 3 months and ordered to pay restitution in the amount of$30,079.05 payable to the Cottonport Housing Authority. IV. PROVISIONS OF LAW: 8. La. R.S. 42:1111(A)(1)(a) provides that no public servant shall receive anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled, for the performance of the duties and responsibilities of his office or position. 9. La. R.S. 42:1102 provides the following relevant definitions when analyzing the above Sections: (18)(a)defines a"public employee"to mean anyone,whether compensated or not, who is: (i) an administrative officer or official of a governmental entity who is not filling an elective office; (ii) Appointed by any elected official when acting in an official capacity, and the appointment is to a post or position wherein the appointee is to serve the governmental entity or an agency thereof, either as a member of an agency, or as an employee thereof; (iii) Engaged in the performance of a governmental function; or (iv) Under the supervision or authority of an elected official or another employee of the governmental entity. (19) defines "public servant"to mean a public employee or elected official.
