La. R.S. 42:1102(18)(ii) defines "public employee" to include an individual who is appointed by <br /> any elected official to a post or position wherein the appointee is to serve the governmental entity <br /> or an agency thereof, either as a member of an agency, or as an employee thereof. <br /> La. R.S. 42:1102(19) defines "public servant" to include an elected official or public employee. <br /> ANALYSIS&CONCLUSION <br /> As an appointed member of the Waterworks, Brian Brown would be a public servant pursuant to <br /> La. R.S. 42:1102(18) and (19). Mr. Brown's agency would be the Cameron Parish Waterworks <br /> District No. 2. <br /> Brian Brown's father is an immediate family member pursuant to La. R.S. 42:1102(13). As such, <br /> La. R.S. 42:1113B prohibits Brian Brown's father and Brown's Grocery Store from selling gas or <br /> grocery items to or for the Waterworks if Mr. Brown is appointed as a member of the Waterworks <br /> board. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Governmental <br /> Ethics.
