Penalties <br /> A.If an investigation conducted pursuant to this Part reveals that any public servant <br /> or other person has violated any law within the jurisdiction of the Board of Ethics to <br /> his economic advantage, and after an adjudicatory hearing on the matter,the Ethics <br /> Adjudicatory Board may order the payment of penalties. Recovery may include, in <br /> addition to an amount equal to such economic advantage,penalties not to exceed one <br /> half of the amount of the economic advantage. <br /> V. <br /> OPINION: <br /> It is the opinion of the Board that GEO Foundation violated La. R.S.42:1117 by remitting <br /> payment to Linda Johnson for services she rendered to GEO Foundation while she was an appointed <br /> member of the GEO Academies EBR Board of Directors and while GEO Foundation had a <br /> contractual,business and financial relationship with GEO Academies EBR,which was prohibited by <br /> La.R.S. 42:1111C(2)(d). <br /> As an appointed member of the GEO Academies EBR Board of Directors,Ms.Johnson was <br /> subject to the provisions of Code of Governmental Ethics pursuant to La.R.S. 17:3996B(20). Her <br /> agency, as defined by La. R.S. 42:1102(a),was GEO Academies EBR and all of the schools under <br /> its jurisdiction pursuant to the Charter School Contracts between GEO Academies EBR and the <br /> Board of Elementary and Secondary Education. <br /> GEO Foundation is a person as defined by La. R.S.42:1102(16)as it is a private nonprofit <br /> organization. <br /> As an appointed member of a board or commission, Ms. Johnson was prohibited from <br /> receiving a thing of economic value for services rendered to a person that has or was seeking to have <br /> a contractual,or other business or financial relationship with her board.
